Aggravated Assault

Aggravated Assault Lawyer in the Woodlands

Your Defense Stays with Me from Consultation Through Trial

I defend people accused of aggravated assault under Texas Penal Code § 22.02. At Ronnie Yeates Law, I personally handle each criminal case from the initial consultation through pre-trial proceedings and trial. I don’t pass the work to a junior associate.

An aggravated assault charge may involve an alleged weapon, a significant injury, family violence, or another circumstance that increases the felony classification. I represent clients facing these allegations in The Woodlands and surrounding Texas counties, building a defense around the evidence and disputed elements in each case.

What Elevates an Assault to Aggravated Assault in Texas?

Texas Penal Code § 22.02(a) requires the prosecution to prove an assault under § 22.01 plus an aggravating element. That element is either serious bodily injury or the use or exhibition of a deadly weapon during the alleged assault. The injury threshold generally requires a substantial risk of death, serious permanent disfigurement, or prolonged loss or impairment of a bodily member or organ.

Aggravated assault is generally a second-degree felony. A conviction carries a sentencing range of two to 20 years in prison and a possible fine of up to $10,000.

Circumstances that can affect the felony classification include:

  • Specified allegations involving a family or household member.
  • An alleged offense against a public servant or security officer.
  • An alleged offense against a witness or informant.
  • Other facts identified in Texas Penal Code § 22.02 that elevate the charge.

Certain aggravating circumstances can make the charge a first-degree felony, punishable by five to 99 years or life in prison and a possible fine of up to $10,000. The applicable classification depends on the alleged conduct, the relationship between the parties, the complainant’s status, and other statutory facts.

A finding involving a deadly weapon may also require at least half of the prison sentence to be served before parole eligibility. Eligibility doesn’t guarantee release, and other calculations or legal restrictions may affect the date.

Firearms Knowledge Applied to Weapon Allegations

I have more than 25 years of experience in criminal law, firearms law, and DWI law, including 17 years as an Assistant District Attorney. During my career, I have handled more than 15,000 criminal cases. That background informs how I examine charging decisions, witness accounts, physical evidence, and the prosecution’s theory.

I am also a federally licensed firearms manufacturer and dealer. I teach other attorneys about Texas firearms law and the National Firearms Act, which governs specified firearms and related registration requirements.

This technical background is particularly relevant when an aggravated assault allegation involves a firearm. I evaluate the alleged weapon, how it was reportedly used or exhibited, and whether the evidence supports the prosecution’s allegation under the governing statute.

The Montgomery County Felony Court Process

Violent crime charges arising in The Woodlands proceed through the Montgomery County District Courts in Conroe. Felony indictments are distributed among the 9th, 221st, 359th, 435th, and 523rd District Courts. I began my legal career as an intern at the Montgomery County District Attorney’s Office, where I investigated cold cases and homicides.

Because aggravated assault is a felony, the prosecution presents the case to a grand jury. The grand jury determines whether probable cause exists to issue a true bill, resulting in an indictment. A no bill ends the prosecution at that stage, although this process isn’t a trial and doesn’t decide guilt.

My defense process includes:

  • Initial consultation: I discuss the charge, known evidence, events leading to the arrest, and current procedural posture.
  • Case investigation: I examine available reports, witness statements, recordings, medical information, weapon evidence, and other relevant material.
  • Strategic planning: I identify disputed legal and factual issues, then determine which require further investigation or litigation.
  • Pre-trial motions: I address applicable evidentiary, constitutional, and procedural issues before trial.
  • Trial representation: I personally prepare and present the defense when a case proceeds to trial.
